Conditions of Sale – Online Foal Auction
By participating in this auction, you agree to the following terms and conditions:
1. Eligibility to Bid
Bidders must be at least 18 years of age.
By registering and bidding, you confirm that all details provided are accurate and that you have the authority to enter into this agreement.
2. Commission & Fees
A buyer’s commission of 5% (five percent) will be added to the final hammer price of each lot and is payable by the buyer.
The total purchase price = hammer price + 5% buyer’s commission.
VAT may be applicable to some lots. The VAT rate of 13.5% will apply in this case or where the purchaser is a flat rate farmer the VAT rate will be 5.2%.
Where the foal is destined for export outside the EU the VAT rate will be zero
Where a valid VAT number is supplied for a buyer outside the Republic of Ireland the VAT rate will be zero.
3. Bidding & Sale
Bids are binding. Once placed, a bid cannot be withdrawn.
The highest bid at the close of the auction will be deemed the winning bid, subject to seller confirmation if applicable.
The auctioneer/organiser reserves the right to:
Withdraw any lot before or during the sale.
Refuse any bid without providing a reason.
4. Payment
Full payment must be made within 2 working days of the auction’s close.
Accepted methods of payment: bank transfer
Ownership of the foal will not transfer to the buyer until full payment has been received.
5. Foal Information & Representations
Descriptions, pedigrees, and information provided are supplied by the seller and believed to be accurate.
All foals are "sold as they stand" and are sold in good faith.No warranty is given by the auctioneer/organiser regarding health, soundness, or future performance.
Buyers are encouraged to make their own inquiries before bidding and all foals are open to a veterinary inspection at the interested buyers request and cost.
6. Collection & Transport
The buyer is responsible for arranging collection and transport of the foal at their own cost.
Collection must be made within 2 weeks of weaning unless otherwise agreed with the seller.
Risk passes to the buyer upon collection/delivery.
The seller undertakes to make the foal available for collection in good health and condition.
7. Default
If the buyer fails to make payment in full within the stated time, the organiser reserves the right to:
Cancel the sale and re-sell the foal.
Retain any part payment as liquidated damages.
Pursue the buyer for any loss arising from non-payment.
8. Disputes
In the event of a dispute, the decision of the auction organiser shall be final.
These terms are governed by the laws of the Republic of Ireland.
